1. Introduction:
This license agreement (“License”) is made by and between Fantasia Pix (“Licensor”) and You (“Licensee”). By downloading, using, or modifying the images provided by Fantasia Pix (“Images”), the Licensee agrees to be bound by the terms of this License. If the Licensee does not agree to the terms of this License, they must not use the Images.
2. Grant of License:
Subject to the terms and conditions of this License, the Licensor hereby grants the Licensee a worldwide, royalty-free, non-exclusive, perpetual license to:
- a. Use the Images for personal, commercial, educational, and any other purposes.
- b. Reproduce the Images in any medium or format.
- c. Modify the Images to create derivative works.
3. Restrictions:
The Licensee shall not:
- a. Use the Images in any way that is unlawful, harmful, or offensive.
- b. Sublicense, sell, or rent any of the Images or derivative works.
- c. Claim ownership or original creatorship of the Images.
4. Attribution:
While not required, the Licensee is encouraged to give appropriate credit to Fantasia Pix, provide a link to the license, and indicate if changes were made to the Images. Such attribution should not suggest endorsement by the Licensor.
5. No Warranty:
The Images are provided “as is,” without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement.
6. Limitation of Liability:
In no event shall the Licensor be liable for any claim, damages, or other liability, whether in an action of contract, tort, or otherwise, arising from, out of, or in connection with the Images or the use or other dealings in the Images.
7. Termination:
This License shall automatically terminate if the Licensee breaches any of its terms and conditions. Upon termination, the Licensee must cease all use of the Images and destroy any copies of the Images in their possession.
8. General:
This License constitutes the entire agreement between the parties concerning the use of the Images. The License may only be modified by a written amendment signed by an authorized executive of Fantasia Pix.
